Please read these Terms and Conditions carefully before using the Umrascanner site (hereinafter the Site) and making a reservation. When you make a purchase on the Site, you agree to accept these Terms and Conditions. 1.1 Umrascanner is available to all users (hereinafter, the "User" or "you"), subject to these terms and conditions (hereinafter "GTC"). By making a purchase on the site or otherwise using the site, you agree to these T&Cs.
1.2 This platform is managed by Umrascanner.LLC, a Wyoming corporation, registered in Sheridan, Wyoming, Wyoming, under file number 2020-000929648, whose registered office is located at: UMRASCANNER.LLC, 1309 Coffeen Avenue, Ste 1200, Sheridan, Wyoming 82801.
1.3 The Buyer hereby declares that he/she is of legal age (at least 18 years old) and has the legal capacity to enter into this Agreement and to use this Site in accordance with the provisions of these GTC, which he/she fully understands and accepts. The Buyer agrees to assume full financial responsibility for any use of this Site towards Umrascanner. The Buyer further declares that all information provided to access and use Umrascanner is true, complete and accurate and undertakes to keep it up to date.
1.4 Umrascanner is for the Buyer's personal use only. It may not be modified, reproduced, duplicated, copied, distributed, sold, resold or exploited for commercial or non-commercial purposes, subject to the possibility of making copies of your travel itinerary for personal use or sending your travel itinerary to an itinerary management company acting in good faith.
1.5 The Buyer undertakes not to use this Site for illegal or prohibited purposes. The Buyer agrees, in particular, to use Umrascanner only for personal purposes and certifies that the products or services purchased on our Site will be intended for his or her personal use or consumption or for the use or consumption of persons on whose behalf he or she is legally authorized to act. The Buyer shall not resell to third parties the products or services purchased on our Site. Umrascanner reserves the right, at any time and without notice, to refuse access to the Site. Any communication relating to customer service or reservations should be sent to email@example.com.
2.1 Through Umrascanner, we offer an online travel agency service. A purchase on Umrascanner means any type of order for products or services that you make with a payment obligation and that has been confirmed by us. By purchasing travel products or services through Umrascanner, you enter into a contract directly with the Travel Supplier(s). We do not form part of the contractual relationship for the products and services you purchase, unless expressly stated otherwise. Any questions or concerns regarding the products or services purchased should be addressed to the relevant Travel Provider or via our customer service department.
When booking on the Umrascanner Website, you must ensure that (i) the name(s)/name(s) of the travellers are spelt correctly and correspond to the name(s)/name(s) on the passport/identity card that will be used as the travel document at check-in, (ii) the e-mail address where you wish to receive all your travel documents is correct and the telephone number indicated (any error may result in additional charges).
2.2 The Intermediary makes the booking on your behalf and your contract will be subject to the terms and conditions of the Travel Provider who may limit or exclude its liability (often under various applicable international conventions). If you wish to read the Travel Provider's terms and conditions, you may consult the links available on our Website. If it is not possible to view the Travel Supplier's terms and conditions via a link, we will, upon request, provide you with the Travel Supplier's contact details so that you can contact the Travel Supplier. Be sure to read the Travel Provider's specific terms and conditions regarding cancellation fees and other important terms and conditions.
2.3 By using Umrascanner to book products and/or services, you authorize the Intermediary not only to represent you during the search process between the different Travel Suppliers and when booking the products and/or services provided by the selected Travel Supplier, but also to proceed to the payment of the products or services in question in your name and on your behalf.
2.4 Prices are confirmed at the final stage of the booking when you click on "Acceptance and Purchase". Prices are indicated according to the exchange rates calculated each day. Prices may therefore fluctuate daily according to changes in exchange rates. Taxes fluctuate according to exchange rates. When a reservation is made, the exchange rate is fixed at that time and will apply to all changes or cancellations concerning the product or service that is the subject of the reservation. Exchange rates are set by the Intermediary.
2.5 After placing your order, you will receive a confirmation e-mail which will constitute your contractual document. This first confirmation email will provide you with all the details of the products or services requested. Thereafter, we will check that your purchase has been correctly taken into account by the system of your Travel Supplier(s) and that your payment can be correctly processed. Our obligation to issue the booking voucher will be subject to the payment having been made in full. You may receive a second email within one (1) business day of receiving the first email, in which we will confirm the issue of your booking(s).
2.6 As payment is an essential condition of the contract, the order will be cancelled for non-payment. This also applies to any rejection of payment, regardless of the cause. The Intermediary shall not be obliged to perform its services until receipt and collection of full payment. In all cases, the Buyer is responsible for the payment of all amounts agreed upon for the products or services ordered. The following are not considered to discharge the debt: the handing over of a bank card number until the agreement of the payment centre is obtained, nor a transfer before confirmation from the Buyer's bank. Likewise, the payment by the Buyer to a travel agency of a service provided by the Intermediary is not considered to discharge the debt as long as we have not received full payment for the service ordered by the said travel agency. If the Intermediary fails to pay the Intermediary's travel agency within the stipulated period, the Intermediary is entitled to cancel the booking made by the travel agency on behalf of the Buyer. Until full payment has been received, the Intermediary is not obliged to perform the service which is the subject of the contract.
Failure by the Buyer to comply with the terms of payment will be considered by the Intermediary as a cancellation by the Buyer. In the event that payment proves to be irregular, incomplete or non-existent, for whatever reason, the sale of the reserved services will be cancelled, the costs arising therefrom remaining the responsibility of the Buyer.
2.7 We reserve the right to cancel your booking if we have good reason to believe that it is fraudulent. In this case, we will try to contact you using the email address you provided at the time of booking. If we are unable to contact you, we will cancel your booking without liability.
2.8 We inform you that the electronic document by means of which the contract is carried out represents the purchase confirmation that you will receive by email. This information, in addition to being sent to you by email, will also be archived in the registers of the Intermediary and you will be able to access it at any time upon request.
2.9 With regard to optional items and special requests that you may make in certain cases to the Travel Suppliers, concerning a particular product (e.g. special foods, equipment for the disabled, child seats, etc.), please note that you will have to inform the relevant Travel Suppliers directly. It is your responsibility to confirm with your Travel Supplier(s) whether these requests can be accommodated.
The process for requesting optional items or special requests from the Travel Supplier(s) is as follows: you indicate your special request when you make your booking; the Travel Supplier will contact you again to request further information.
2.10 We provide you with a specific page listing the most booked Hajj and Umrah suppliers on our website, and giving you access to the information you need to prepare your trip (conditions of carriage, luggage policy, etc.). You are informed that only the travel supplier has control over this information, and that consultation of these rules is fundamental in the organization of your trip. If no link is provided for the travel agency that you have booked, you must go and consult them directly on its website.
For a better preliminary information, Umrascanner invites the Buyer to visit the website of the Ministry of hajj to get acquainted with the approvals and guarantees concerning the travel supplier with which you are engaged.
3.1 Cancellations and changes
3.1.1 Your right to cancel or change a booked travel product or service and the procedure to follow depends on the Travel Suppliers' general terms and conditions. You may not be able to cancel or modify products or services ordered or you may be obliged to meet specific requirements. The right of withdrawal does not apply to contracts for the provision of accommodation, transport, catering or leisure services which are to be provided on a specific date or at a specific time. For all the services offered by Umrascanner belonging to these various categories, the Buyer does not benefit from any withdrawal period within the framework of orders placed on our Site.
In the event of possible modification of your reservation (modification, except request for refund), this is the sole responsibility of the travel supplier, who could if necessary claim cancellation or modification fees, including any difference in airfare/room prices. If you change your reservation, please note that the current rates shown on the site will not apply to your change of reservation.
3.1.2 You must be aware of all tariff rules relating to your booking. Exchanges and cancellations on the day of departure cannot be made by email. You must contact the travel supplier and comply with their conditions of sale.
3.1.3 When you change your booking, it is your responsibility to ensure that the change does not affect any other products or services you have purchased.
3.2 Prices and payment
3.2.1 The total price of your reservation will be communicated to you as soon as you have selected all the products you wish to purchase. This price will include the price of all the products selected as well as the Intermediary's commission. The Intermediary's commission is independent of the price of the products and is non-refundable as it is charged for research and support services provided during the booking process.
3.2.2 The amount of the commission depends on the products purchased. The Intermediary may also charge an additional commission if you make a reservation by telephone or if you request changes or a refund. If you use an unfunded credit card or if your credit card is declined by the bank for any other reason for which you are responsible, Umrascanner reserves the right to charge you a fee and will inform you immediately to make arrangements to pay for your reservation. Once payment has been made in full, the estimated handling fee will be deducted from the full final price of your purchase. Until you have paid your purchases in full, you will not be able to receive your products. We would also like to draw your attention to the fact that due to the nature of travel products, it is possible that the price may change between the date of booking and the date of actual payment, and you will therefore be liable for the price in effect at the time you make the payment.
3.2.3 If you pay by credit card, the price of the travel packages can be collected directly by the travel agency. If there is a problem with your payment, we will contact you within 48 hours of your reservation (or within 24 hours if you travel within 48 hours). Umrascanner will not be responsible for any price increase resulting from non-payment. You must pay the price increase before the reservation is confirmed. Please be aware that the payment of Umrscanner's service fees may appear as separate transactions on your bank statement.
3.2.4 Payments can be made using the major debit and credit cards listed on our Site. Means of payment other than those mentioned on our Site are not accepted and Umrascanner declines all responsibility in case of cash payments or cheques sent by post.
3.2.5 In order to guarantee a better security, we will ask you to enter all the information that appears on your card for each purchase that you make with Umrascanner since this information is kept in our files only for the time necessary to carry out the payment of each reservation or to proceed to the collection of taxes referred to below in point 3.3. Please note that the Intermediary is obliged to transmit the information on your card to the relevant Travel Supplier in order to make the reservation. By accepting these GTC, you authorise us to provide this information. All information is encrypted on our secure server. You authorise the Intermediary to use the credit card information to (i) purchase the requested services and process the related fees, (ii) pay insurance premiums and tourist assistance, if applicable, (iii) make authorised refunds and (iv) charge fees and commissions relating to (a) the modification of your booking following a request by you or (b) the refund of taxes as referred to in Article 3.3 of these GTC.
3.2.6 Umrascanner reserves the right to pass on the costs of card rejections. If your booking is paid for with a third party credit card, we may require written authorisation from the holder of that card. Umrascanner or the Travel Provider reserves the right to deliver confirmations, electronic receipts or other travel documents only to the email address or billing address of your credit card if requested to do so by the credit card issuer. All e-mail addresses must be valid at the time of booking.
3.2.7 In an effort to minimise the effects of credit card fraud, we reserve the right to carry out random checks and may request that you provide us by email with proof of your address and a copy of the credit card and recent statements made before the Tickets are issued. Please note that these checks are only carried out during our normal business hours. Therefore, all receipts for bookings made outside of our business hours can only be issued on the next business day. Umrascanner is not responsible for any costs incurred as a result of these checks.
3.2.8 In certain cases, subject to the prior approval of Umrascanner's Customer Service, the Intermediary will debit the total amount of your reservation in a single payment. You must ensure that your account is sufficiently funded to make the full payment. In case of rejection of payment due to lack of funds or other reasons attributable to you, Umrascanner will charge you a management fee of thirty-five euros (35€). Umrascanner will indicate you the procedure to follow to complete your payment and finalize your purchase. This fee covers bank charges and other related costs incurred by Umrascanner.
3.3.1 Refunds, if any, will be made using the payment method used at the time of your purchase and in the name of the person who made the initial payment. When requesting a refund of an offer, please note that not all items that make up the offer price are refundable. Any refund, although requested through us, will be made in accordance with the refund policy of the relevant Travel Supplier(s).
3.4 Passport, Visas and Medical Requirements
3.4.1 For information on the applicable legislation regarding passports and visas, we inform you of the need to consult the relevant embassy before leaving on your trip or official websites such as http://www.diplomatie.gouv.fr/fr/ or https://www.action-visas.com/. It is your responsibility to be in possession of a valid passport, to complete the required administrative or health formalities and, where applicable, to be in possession of a visa. Umrascanner is in no way responsible for the consequences of not possessing a valid travel document.
3.4.2 Each destination has its own conditions regarding entry formalities, vaccination, etc., which may vary according to the nationality of the passenger. We recommend that you make sure you are well informed before planning your trip. We are in no way responsible for incidents arising from non-compliance with these official provisions.
3.5 Electronic tickets (e-tickets) Electronic tickets (or "eTickets")
3.5.1 All the formulas sold on our Site are formulas of hajj and Umrah. The issue of electronic tickets is an intangible form of booking flights. Umrascanner will send you a confirmation e-mail with your reservation number which will serve as a receipt for payment of your Umra or Hajj reservation, the full documents of which will be provided to you by the travel provider. You will not receive a paper ticket from us to present at the airport.
3.5.2 The Travel Provider may ask you for your booking number and/or confirmation e-mail as proof of your booking. We recommend that you print out the confirmation e-mail, although not all agencies ask to see it. Please be aware that travel providers have their own rules and regulations regarding reservations.
3.5.3 Umrascanner believes that the information you provide is accurate and therefore cannot be held responsible if your email receipt does not arrive due to an incorrect email address or your spam settings. You should inform us immediately if you change your email address or phone number. In addition, please check that the name on your passport matches the name on your ticket and/or booking confirmation. Umrascanner cannot be held liable if the Buyer has provided incorrect contact details or information when ordering. Umrascanner cannot be held responsible for any negligence on the part of the Buyer.
3.5.4 In exceptional circumstances, due to ticketing restrictions beyond its control, Umrascanner may not be able to transmit information on confirmed bookings to the travel agency/ or travel supplier to enable it to make the booking. If this happens, we will attempt to inform you within 48 hours of confirmation and make a full refund or find an alternative solution. If you choose an alternative solution and it is more expensive than your original booking, you will have to pay the difference.
3.6 Travel Insurance: The Intermediary leaves you free to take out travel insurance or not, especially since, in certain circumstances, the Travel Provider will have no liability.
3.7 Loyalty Programs: When booking a trip, you have the opportunity to enter data relating to the loyalty programs of travel suppliers of which you are a member. We draw your attention to the fact that each of these loyalty programs is subject to the general terms and conditions of each travel supplier company. These terms and conditions may restrict the benefits granted to certain fares or classes. In case of doubt, it is recommended that you contact the travel agency/travel supplier depending on your loyalty program. We also draw your attention to the fact that our Travel Suppliers have their own rules and regulations regarding loyalty cards. If you have any questions, please contact them directly. Travel Suppliers offer different loyalty programs; the benefits offered vary from one agency to another. We are not responsible for these variations and if you want to know how many points you can earn, we advise you to contact customer service before booking your holiday.
4.1 "Products and services offered by third parties" (tourist packages, hotels and other accommodation etc.). We will apply the conditions of the Travel Supplier and refer to Appendix 3.
7.1 Umrascanner provides its various platforms as is and makes the necessary efforts to ensure that they are updated, maintained and operational, but no guarantee is made by Umrascanner regarding technical defects or infallibility of operation nor does it guarantee the operational character of its various platforms at all times.
7.2 Umrah scanner makes public various information on products and services offered and/or provided by third parties and makes no representation as to the truthfulness, veracity, completeness and up-to-dateness of the data contained in these offers.
7.3 Umrascanner's limitation of liability is in accordance with the currently applicable legislation and, in particular, with the provisions of the regulations applicable to travel agencies. Consequently, Umrascanner disclaims any liability in case of damage resulting directly or indirectly from the purchase of a product or service offered on its Site. If the limitations set forth in this Article 7 are challenged by a court of law as to the liability of Umrascanner for damages caused by the purchase of products or services on its Website, such liability shall at all times be limited to the commissions received by Umrascanner for services provided, unless otherwise provided for in the local implementing provisions of the Package Travel Directive.
7.4 In case of force majeure (including, in particular, political or social unrest or a precarious situation affecting security), irregularities in reservations, confirmations and/or the execution of trips or the provision of services due to the occurrence of unexpected events beyond the control of Umrascanner exceeding its capacity to manage; Umrascanner and/or the companies of the Umrascanner LLC Group are released from all legal responsibilities incumbent upon them as a result of such irregularities or non-compliance.
8.1 The Umrascanner Website may contain links to other websites which are not managed by Umrascanner and which appear only for referential purposes. Umrascanner has no control over these websites and is not responsible for their content.
8.2 The presence of these links does not imply that Umrascanner, guarantees their content or recommends them. These links appear only for information purposes, without prior evaluation of their content, nor of their owners, services or products.
9.1 Complaints about your booking: For any queries or complaints relating to your purchase prior to your departure, please contact our Customer Service Department. In the event of a complaint about a Travel Supplier, it is your responsibility to direct your complaint directly to the Travel Supplier before your return.
After contacting Customer Service, if you are not satisfied with the response and/or if you do not receive a response within 60 days, the Purchaser may refer the matter to the Tourism and Travel Ombudsman, whose contact details and methods of referral are available on the website www.mtv.travel.
There is also a dispute resolution platform set up by the European Commission, which can be accessed via the following link: http: //ec.europa.eu/consumers/odr/.
9.2 Customer Behaviour: It is not appropriate for you to engage in any inappropriate behaviour that harms or endangers third parties or may cause damage to third party property (including, in particular, due to drunkenness and/or air rage) while on holiday or when using a service/product. If your behaviour is unsuitable and/or injures or harms others or is likely to cause damage to the property of others, we and/or our Travel Provider (e.g. tour guide) may cancel your booking, in which case our liability and that of our Travel Provider will cease immediately and you will not be entitled to any refund, compensation or reimbursement of any costs incurred as a result of such cancellation. In addition, You must reimburse us for any costs incurred by us in connection with such termination.
9.3 Amendment of the GTC
9.3.1 These GTC represent the entire agreement between the parties concerning the subject matter hereof.
9.3.2 In the event that any provision or provisions of these GTC are deemed to be invalid or become invalid or unenforceable for any reason whatsoever under applicable law, such provision(s) shall be deemed to have been deleted from these GTC and the validity and/or enforceability of the remaining provisions of the GTC shall not be affected or impaired thereby.
9.3.3 Umrascanner reserves the right to temporarily modify or update these GTC without prior notice. The version of the GTC in force will appear on the Site as of the date of entry into force of the modifications. Your continued use of the Site following the posting of changes will signify your acceptance of those changes.
These GTC are subject to French law within the limits of the legal provisions in force. Any dispute relating to their interpretation and/or execution shall be subject to the courts of the European Union country in which you reside pursuant to the legal provisions in force.
As the order is an order by which the Buyer asks the comparator to perform a service, it does not constitute a definitive confirmation. It informs the Buyer that the order has been registered for processing. The file will be considered as reserved and confirmed as soon as the payment is validated. By e-mail, Umrascanner sends an acknowledgement of receipt indicating that the reservation is being processed. This acknowledgement of receipt recalls the essential elements and the file number. Umrascanner will send the Buyer the order confirmation reminding the essential elements (the booked service, price, quantity, date of travel, name of the beneficiary of the service etc.).
In the absence of such a document, the reservation will not have been taken into account. The Buyer must ensure that he/she receives mail regularly in his/her e-mail box, in particular by checking his/her e-mail in "Spams" or "Junk Mail". If the Buyer transmits erroneous coordinates in one of the elements of his order, Umrascanner could not be held responsible. Any negligence of the Buyer cannot be imputable to Umrascanner.
Pilgrimage packages purchased through our website will be entered into with the relevant Travel Provider and will be subject to their terms and conditions. Although We, as the intermediary, are not responsible for schedule changes and cancellations, We will provide all reasonable assistance you may require through our Customer Service Department.
Travel agencies may charge for additional services, such as tours not included in the package, private car rental, seating preferences on flights, entertainment (if available), food, beverages, etc. The cost of these additional services is not included in the price of your reservation, unless expressly stated otherwise, and you will have to pay the travel supplier.
We are not responsible for any additional costs incurred, and we invite you to contact the relevant provider to aggregate the additional services and verify the costs.
11.1 Services and Related Fees
Invoice transfer (e.g. request for an invoice in the name of the company): 10 euros/per invoice.
Miscellaneous certificates: 10 euros/per certificate.
12.1 Definitions - General Information: Payments can be made using the major debit and credit cards listed on our Site. Payment methods other than those mentioned on our Site are not accepted and Umrascanner declines all responsibility in case cash payments or cheques are sent by postal mail. Full payment for all products is required at the time of booking, except for agency payments, for which the booking will only be confirmed after receipt.
12.2 Liability: In the sale of "formula", We act as a simple intermediary or agent of the Buyer, and not as a tour operator. Accordingly, (i) you will enter into a travel contract with the travel supplier, subject to its own terms and conditions of sale and (ii) We act as a mediator in the purchase of your products or services.
For accommodation, read the description of the hotel or accommodation carefully before booking. In particular, we recommend that you pay particular attention to the following:
Category (stars): you should note that this is not necessarily the official local rating and that the rules may vary between hotels and accommodations of the same class in different countries and even within the same country. Different countries have different standards: a 3-star hotel in one country is not necessarily equivalent to a 3-star hotel in another.
Illustrations: We endeavour to ensure that the images of the establishments and descriptions of the services and facilities that appear on the Site are an accurate and up-to-date representation, but we cannot guarantee that they will always be so. We obtain this information from our Travel Suppliers.
Location: We try to provide you with the most accurate information about the location of the hotel in relation to the sacred mosques, but we cannot guarantee that this will always be the case, as we obtain this information from travel suppliers.
Room type: The images of the room types do not necessarily represent the bed configuration in the booked room. For example, a triple room in the United States may consist of a double bed and a single bed, or a double room in Austria may consist of two single beds. Additional charges may also apply for extra beds or cots.
Breakfast: normally not included unless otherwise stated.
Local taxes: Some hotels may charge additional local taxes. The Buyer will be given, after full payment, a voucher included in the confirmation e-mail ("Voucher"). Only the services mentioned exclusively on the voucher are included in the price of the service.
Umrascanner will only charge the Buyer the possible expenses that will appear on the total price before validation of the order for payment. The entirety of this information concerning a possible payment on the spot will be communicated to you in the summary e-mail including the acknowledgement of receipt.
The Travel Supplier can be brought, for multiple and legitimate reasons and independently of Our will, to substitute the hotel initially reserved by another hotel of the same category proposing equivalent services without giving right to a compensation without this measure constituting a modification of an essential element of the trip. As far as possible, the Buyer will be notified in advance. Failing this, the Supplier shall be responsible for relocating the Purchaser to an establishment offering equivalent levels of comfort and quality.
Our platform contains links or redirections to Travel Provider websites that offer related products or services: visits to holy cities (Mecca, Medina), pilgrimage to holy cities (Mecca, Medina) etc.
These links or redirections may concern a totally independent website or a microsite managed technologically by Us but commercially exploited by the Travel Provider.
If you purchase products or services offered by third parties in accordance with the above, you will be under contract directly with the Travel Supplier without Us intervening in this purchase, not even as an agent or intermediary. Therefore, you will be subject to the terms and conditions of the Travel Supplier. In such cases, We only act as a service provider in accordance with the legal provisions in force.
